Terms of use

1. Description of Service
The MobiMake product is fully operated from its owner, Global Response Media (GRM). MobiMake (the "Service") is an entertainment service that enables users to earn MobiMake credits by accepting to receive advertisements on SMS and e-mail from GRM. A user receives MobiMake credits when he/she receives advertisement SMS from GRM. A user can also recruit new members and will receive MobiMake credits when users recruited by him/her receives advertisement SMS from GRM.

You understand and agree that the Service is provided "AS-IS" and that GRM may modify the Service at any time and that GRM specifically reserves the right from time to time to alter the use and functionality of the MobiMake credits.

2. Your Registration Obligations
In consideration of your use of the Service, you agree to: (a) that you are 15 years of age or older and (b) will provide true, accurate, current and complete information about yourself as prompted by the Service's registration form. If you provide any information that is untrue, inaccurate, not current or incomplete, or GRM has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, GRM has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof). GRM will only use your registration data in accordance with GRM Privacy Policy.

3. User Account, Password, and Security
Your user id is your registered mobile phone number. Upon registration you will receive your password on SMS. You are responsible for maintaining the confidentiality of the password for your account, and are fully responsible for all activities that occur under your account. You agree to (a) immediately notify GRM of any unauthorized use of your account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. GRM cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 3.

4. User Conduct
You understand that, you, not GRM, are entirely responsible and liable for all activities conducted through your account, including recruiting new members. Under no circumstances will GRM be liable in any way for any activities conducted through your account. Listed below are some, though not all, violations that may result in GRM terminating your account. You agree not to do any of the following actions while using the Service:

Collect or store personal data about other users; Try to recruit new members using phone numbers from people you don't personally know or that has explicitly agreed to you sending he/she a recruitment SMS. Try to recruit new members that are under the age of 15.

5. International Use
Recognizing the global nature of the Internet and wireless messaging, you agree to comply with all local rules regarding online and telecommunication conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.

6. No Resale of Service
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

7. Modifications to Service
GRM reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that GRM shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

8. Termination
You agree that GRM, in its sole discretion, may terminate your account (or any part thereof) or use of the Service, and delete your MobiMake credits within the Service, for any reason, including, without limitation, for lack of use or if GRM believes that you have violated or acted inconsistently with the letter or spirit of this Agreement. GRM may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this Agreement may be effected without prior notice, and acknowledge and agree that GRM may immediately deactivate or delete your account and all related information. Further, you agree that GRM shall not be liable to you or any third-party for any termination of your access to the Service.

9. Dealings with Advertisers, Partners and Users
Your correspondence or business dealings with, or participation in promotions of, advertisers and partners found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser or partner. You agree that GRM shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers or partner on the Service. In addition, GRM does not regulate user-to-user dealings, therefore, in the event you have a dispute with one or more users of the Service, You agree that GRM shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such user or users on the Service.

10. Links
The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because GRM has no control over such sites and resources, you acknowledge and agree that GRM is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that GRM shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

11. Notice
Notices to you may be made via email, SMS (short message service), regular mail, or the Service may also provide notices of changes to this Agreement or other matters by posting notices or links to notices generally on the Service.

12. Violations
Please report any violations of this Agreement by using customer service contact form.

13. Mobile Registration
Your use of this service and interaction with other users is at your own risk. Your profile can be viewed by the user that has recruited you. You may receive messages from GRM or our partners at any time.
